Copyright is Federal.
I was awarded $10,000 and a public apology to appear in the newspapers.
I had found it necessary to seek legal advice and eventually to go to
Federal court when my little Village of Irvington, NY appropriated my artwork,
sent it out to all residents and businesses as their New Year's card without my
knowledge, removing my signature and copyright symbol. (And by the way putting
that sign may just mean intent to copyright. As someone said copyright is
automatic in the US.).
I asked for no money, only an apology and a correction from the Village.
All I got was a run-around.
Did this cost me $$$ legal fee.? NO. Only the $50 for the first letter to
Village of Irvington, which a lawyer wrote and was not answered. And a standard
% of the award to the lawyer.
Whether I had ever sold a piece of art for $10,000 was not an issue. Whether
I had registered the art was not an issue either.
The Editor of Artist's magazine, Mike Ward, wrote about this in his Letter to
the Editor, Artist's Magazine,
November '94. It was for people like us and artists across the country.
Once I sent that letter to Baren for the files.
(While this was going on in the early 90's and entirely by coincidence I went
into a Geary St. gallery in San Francisco, a dealer of Vargas art. The
gallery owner told me all about Vargas and his copyright case.The information
helped a lot. I went home and did a bit of research. Two days ago, now more than
10 years later, I was back in San Francisco and told the update of my case!!)
It is important for us and interesting to read a book about the business of
art. The phone number for the US Copyright Office was (202-707-3000), forms
free of charge, filing fee was $10.

My head is still buzzing with all the information, have printed it all out and will act upon some of it.
It seems like any type of creativity is victimized in this society.
