Baren Digest Wednesday, 6 September 2000 Volume 12 : Number 1136 ---------------------------------------------------------------------- From: "Thomas W. Hayes" Date: Tue, 5 Sep 2000 10:03:51 -0400 Subject: [Baren 11205] Re: Copyright Everyone, I don't know how familiar you all are with copyright, but here is the Copyright Office's website at the Library of Congress: http://www.loc.gov/copyright/ I know that you can request a formal copyright certificate on any item. The fact is, however, as soon as you put something down in any fixed medium you own it. No one can take it from you or claim it as their own or use it for commercial purposes without your consent. A formal application for copyright gives you much stronger protection, but as soon as you create something in a fixed format it is copyrighted. I would hesitate to put a (c) on any of my prints, how does everyone else feel about this? I congratulate Carol for her and her husband's strength. I have heard stories like this a thousand times (not just copyright mind you) and still cannot believe there are people who behave in such crude and ignorant manner. Using one's position in a public office to leverage opinion and general reaction for an illegitimate cause should be punished severely. That mayor is lucky only a resignation followed the case. It must have been a terrible turmoil then and yet now, well you have and are reaping the benifits. Just a reminder to all that it is important to put that little copyright symbol.... (c) on all original work. I realize that since doing the woodblock prints I have never used the symbol.... I wonder if I am leaving myself open to problems. Anybody got a thought on this? Graham ps When it came out in the newspapers the Mayor "suddenly" resigned, quit his day job, sold his house, and moved to Vero Beach, Fla. Hey Dan ..... beware of this guy. Do you live close to Vero Beach? << File: ATT00004.html >> ------------------------------ From: Bob Russman Date: Tue, 05 Sep 2000 10:56:49 -0700 Subject: [Baren 11206] Re: Copyright Hi, I just subscribed to the group last night. I am a photographer, and have done some watercolor and oil painting. I just ordered supplies to do my first "serious" relief printing. They should be delivered this week. With regards to copyright: Every artist should be familiar with copyright law as well as respect the copyright ownership of other artists work. All work should be original and not a "derivative" of another persons creation. An artists work is copyrighted at the time of creation. To be awarded damages for infringement the work must be registered. The work must be registered within a certain time period of its publication (I believe it is 3 to 6 months). For protection, the back of prints can be stamped with the © and year and the artist's name. ©2000 Bob Russman All Rights Reserved This could also be attached to the back of the print on a "Certificate of Authenticity" or an "Edition Statement". There may be some artists on the list that are currently doing this. Any comments? Anyway, I look forward to getting my supplies, and getting some input from the group. I have a lot to learn. In the USA, they often consider the symbol as notification to the viewer/buyer. However, I do not think it is a legal requirement, although there have been legal rulings where non-use of the symbol was used to successfully argue that the buyer did not know. ************snip******************** Regards Graham ------------------------------ End of Baren Digest V12 #1136 *****************************
