And that sort of defeats the purpose. like the article says, a few staunch advocates like Carol are the best way of educating people about copyright and artists' "rights" Gerald - -- ------------------------------------------------------------------------ Gerald Soworka - On-line Gallery and Portfolio http://www.crosswinds.net/~geralds/art.html Contains gallery of prints, drawings and paintings, as well as a detailed résumé and calendar of forthcoming exhibitions and activities, including:Trevor was a chiropodist, but Kevin is the dancer< ------------------------------ From: B Mason Date: Sat, 02 Sep 2000 07:24:57 -0700 Subject: [Baren 11192] law suit Carol, Major congratulations on winning that law suit!!!!You are certainly made of the right stuff to stick this out. I think they made a big mistake and to think it could have been handled so simply with a credit and an apology. I think whoever did this had no idea that artist's images are their own, you certainly educated a lot of people but it is too bad the whole town administration was against you. Were you audited too? You wonder how high this kind of "cover-up" for bureaucratic mis-management goes. My nephew has the job of policing the IRS. He said one year he was auditied and they gave him a bit of a hard time, he said through it all he kept thinking to himself, "You guys would be a lot nicer to me if you knew what my job really is!" Of course they did not know as he could not do it if they knew who he was. There should be someone like him in every local government to keep things on the up and up. That was a difficult time and I must give credit to my husband. We had to do strategy together because our lawyer wasnt that good and we were up against the Hartford Ins. Co. which had tricks up their sleeves. When it came out in the newspapers the Mayor "suddenly" resigned, quit his day job, sold his house, and moved to Vero Beach, Fla. Afterwards there were no negative repercussions or reactions against me. It didn't hurt my art. In fact, a leading real estate holder stoppped me on the street to give me a painting commission . The historic church he owned was being torn down to make way for a housing project for village workers and he wanted a watercolor remembrance of it. Now, 8 years later ,my watercolors including 3 historic Irvington churches are being shown in the Irvington bank, for the benefit of the American Cancer Society. Two sold to people with an historic connection to them. This is the first time I am putting these thoughts together. I find myself thinking "What goes around comes around" Also of interest, after the Court's decision and settlement the Irvington Village made a stipulation before giving the check, that I not speak to the New York Times or local papers. My lawyer persuaded me to sign and get it over with. I did. BUT, all along I was writing letters to the newspapers telling the story . They kept those letteres and did nothing with them at that time .Upon completion of the case the newspapers reported the whole true story using the letters I had sent and the Court's decision. With the $10,000 less the % for the lawyer, my husband and I went to Alaska. Cut and Print! It must have been a terrible turmoil then and yet now, well you have and are reaping the benifits. Just a reminder to all that it is important to put that little copyright symbol.... =A9 on all original work. I realize that since doing the woodblock prints I have never used the symbol.... I wonder if I am leaving myself open to problems. Anybody got a thought on this? Laws are changing. Get the latest book on the subject . Some states are more protective of artists' rights than others. New York and California are leaders in protection. By the way, my copyright sign and signature were removed( white-out?)and then the art was used. I had signed in the work itself, but unobtrusively. There was no doubt about that. Belated congratulations, Carol, for standing up and winning this! Must have been a horrible year for you, but I'm happy that it's mostly behind you now. Nice drawing, too... I wonder why the city didn't simply contact you for consent to use the image in the first place? Is there anything uglier than government in denial?
